Alberta’s Minor Injury Cap
If you have sustained a soft tissue injury in a car accident you may have heard people talking about the minor injury cap and you may even have been told that your injury is “caught by the cap.” The cap is a cap on damages payable for pain and suffering for this type of accident but it does not always apply to soft tissue injuries. Where a soft tissue injury has caused you to experience chronic pain symptoms over an extended period of time it may well be that the cap does not apply.
