Buses, such as those operated by the City of Edmonton and other municipalities, Red Arrow, Ebus, SunDog Tours and Cold Shot are “public carriers”, and as such, have heightened obligations to their passengers. The duty of the bus owner and bus driver is to carry bus passengers safely and to use all “due, proper and reasonable care and skill to avoid or prevent injury to the passenger.” In typical car accidents the injured person must show that the other driver was at fault.  With public carriers, there is a “reverse onus”, and the public carrier must show that the bus was being driven in a “skilled and prudent manner”. Trick-or-treating is back! For those who celebrate Halloween, this is a wonderful time of the year. For an experienced plaintiff’s personal injury lawyer, however, Halloween can be a hazardous night. It’s never a bad call to review Halloween safety tips.

Children and teenagers, decked out in Halloween costumes, will be out and about, going from house to house to gather treats from strangers, frequently in unknown neighbourhoods and in darkness. And don’t forget people of all ages attending Halloween parties where alcohol or drugs may be in the mix.

The leading cause of death for Canadian children is unintentional and preventable accidents, according to Raising Canada 2020,  a report produced by non-profit children’s welfare organization Children First Canada. Further, data from the Public Health Agency of Canada published in Injury in Review, 2020 Edition confirms that a major cause of serious injuries and death for Canadian children is transportation collisions.

What you Need to Know if you are Injured in an Accident with a Truck or Commercial Vehicle.

How serious of a problem are accidents with heavy trucks?

We are sure that all of Canada still mourns for the Humboldt Broncos junior hockey team members killed or injured in 2018 when their bus collided with a transport truck at a highway intersection near Tisdale, Saskatchewan. The crash killed 16 team members of the 28 Broncos on the bus, including players, coaches and other team staff, headed for a hockey game in the neighboring community of Nipawin. As the Broncos bus entered an intersection on the highway, it was struck by a transport truck carrying bales of peat moss, which had failed to stop at the flashing stop signs at the crossroads, as it was required by law to do. During the month of August we biked and walked a total of 2301 km and we are proud to have raised a total of $3550 for the Brain Care Centre.

The Brain Care Centre is a local non-profit that provides programs and services to people who have sustained brain injuries and offers support to their caregivers. CAM LLP knows the importance of access to quality rehabilitation and recovery resources for our clients and their families.
